These Terms & Conditions (“Terms”) govern your access to Ready on the Day and related websites, applications and services operated by Top NoCoders FZCO (“Top NoCoders”, “we”, “us” or “our”). By using the service, creating an account or placing an order, you agree to these Terms.
1. Eligibility
You must be at least 18 years old and legally capable of entering a contract to use paid services. You must provide accurate information and keep account credentials secure. You are responsible for activity conducted through your account.
2. The service
Ready on the Day provides independent educational practice for exams, interviews and professional assessments. Features may include questions, timed exercises, voice role-plays, writing analysis, transcripts, AI-generated feedback and progress reports.
We may improve, add, remove or temporarily suspend features. We will not materially reduce an already purchased service without providing an appropriate remedy required by applicable consumer law.
3. Independent preparation service
We are not an exam board, regulator, university, employer or professional licensing body. Unless explicitly stated otherwise, Ready on the Day is not affiliated with or endorsed by the owners of any exam or assessment referenced on the service. Names and trademarks belong to their respective owners.
4. No guaranteed result
Scores, readiness estimates and feedback are educational guidance and may contain errors. They are not official results and do not guarantee that you will pass an exam, receive a particular score, obtain registration, secure a visa or receive a job offer. You remain responsible for checking official requirements and making your own preparation decisions.
5. Orders, prices and payment
Prices, currency, included features and any taxes are displayed before payment. An order is accepted only when payment succeeds and we issue confirmation. Clicking a cart or checkout button without a successful payment does not create an order or charge.
Payments may be processed by a third-party provider such as Stripe. Its additional terms may apply. We do not store complete card details. If checkout is unavailable or payment fails, no access is purchased unless you later receive a successful order confirmation.
6. Practice access
The OET Simulator gives you a limited, personal licence to use the activities included in the offer shown at checkout. Access is for your own preparation and may not be sold, shared or transferred.
The number of mock tests, available skills and any access period will be shown before payment. If we permanently discontinue a paid service before you can reasonably use your purchase, we will provide an appropriate remedy as required by applicable law.
7. Cancellations and refunds
Any product-specific cancellation or refund terms shown at checkout form part of these Terms. Nothing in these Terms limits a mandatory refund, cancellation or consumer right that applies to you. To ask about an order, email [email protected].
8. Your content
You retain ownership of original answers, recordings and materials you submit. You grant us a limited, worldwide licence to host, process, reproduce and analyse that content only as necessary to provide, secure and improve the service and as explained in our Privacy Policy. You must have the right to submit the content and must not include another person's confidential information without permission.
9. Acceptable use
You must not:
- use the service unlawfully, fraudulently or to harm another person;
- attempt to bypass security, usage limits or payment controls;
- scrape, copy, resell or systematically extract practice content;
- upload malware, infringing content or confidential patient information;
- use generated content as medical advice or in place of professional judgement;
- misrepresent estimated scores as official exam results.
10. Our intellectual property
The service, brand, software, designs, original questions, scenarios and feedback systems are owned by or licensed to Top NoCoders. We grant you a personal, limited, non-exclusive, non-transferable and revocable right to use them for your own preparation. No other right is granted.
11. Third-party services
The service may rely on third-party hosting, AI, speech, analytics, payment and communication providers or link to third-party websites. We are not responsible for independent third-party services, and their terms and privacy practices may apply.
12. Suspension and termination
You may stop using the service at any time. We may restrict or terminate access where reasonably necessary to address fraud, security, unlawful conduct, material breach or harm to the service or others. Where practicable, we will provide notice and an opportunity to remedy the issue.
13. Liability
Nothing in these Terms excludes liability that cannot legally be excluded. To the extent permitted by law, we are not liable for indirect, incidental or consequential loss, loss of opportunity, exam fees, immigration outcomes, professional registration decisions or employment decisions arising from reliance on practice feedback.
To the extent permitted by law, our aggregate liability relating to a paid service will not exceed the amount you paid us for that service during the twelve months preceding the event giving rise to the claim. Mandatory consumer rights remain unaffected.
14. Governing law and disputes
These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. Subject to any mandatory consumer right to bring a claim elsewhere, the courts of Dubai have exclusive jurisdiction. Before filing a claim, please contact us so we can try to resolve the issue informally.
15. Changes and contact
We may update these Terms. Material changes will apply prospectively, and we will provide notice where legally required. Continued use after an update takes effect means you accept the revised Terms.
